Secondly,  zoos can protect the future of many animal species. Species that are in danger of extinction, may breed in zoos so that many animals have a chance of survival.

Przedstawienie jednego lub dwóch kontrargumentów oraz odmiennego stanowiska.

Critics of zoos say that such places are cruel. They think so because, in their opinion, zoos cannot recreate the environment in which animals live. That makes animals depressed and bored. What is more, animals have frequent contact with visitors who come to zoos and this may be stressful for them.

3. Zakończenie  – podsumowanie zgodne z tematem i treścią wypowiedzi i/lub sformułowana inaczej własna opinia.

Although zoos are not perfect places for animals, I think that they have more pros than cons. As long as people hunt animals and destroy their environment, zoos are very useful.

On the other hand, traditional letters have that unique, tangible physical presence, which can hold attention of a recipient for much longer than an e-mail. As a result, many people keep letters for a long time as mementos. 

Summing up, in my opinion, electronic mail is a faster and more practical alternative to traditional letters which is a very important factor to consider in the modern world, where we rarely can spend much time on something.

What Are the Requirements of an Opinion Essay?

Avoid Going Off-Topic: Always write an opinion essay within relevance to answer the assigned question. This is also known as ‘beating around the bush' and should not be included in any opinion paragraph as it may lower your grade.

Indent the First Paragraph: With most academic papers, opinion writing is not different. Therefore, it contains the rule of indenting the first line of the introduction.

A Well-Thought Thesis: The full thesis statement is a brief description of the opinion essay. It determines the rest of the paper. Include all the information that you wish to include in the body paragraphs

The Use of Formal Languages: Although it is okay to write informally, keep a wide range of professional and formal words. This includes: ‘Furthermore,' ‘As Stated By,' ‘However', & ‘Thus'.

Avoid Internet Slang: In the opinion paper, avoid writing using slang words. Don'tDon't include words like ‘LOL', ‘OMG', ‘LMAO', etc.

The Use of First Person Language (Optional): For the reason of providing personal thought, it is acceptable to write your personal opinion essay in the first person.

Avoid Informal Punctuation: Although the requirements allow custom essay for the first-person language, they do not permit informal punctuation. This includes dashes, exclamation marks, and emojis.

Avoid Including Contradictions: Always make sure all spelling and grammar is correct.

Many people believe that education would be more effective if it was optional. I understand their point of view and in my opinion they are right, but I cannot agree with all they claim.

In my view, it would be better for the society and teenagers if education was optional. Nowadays, all young people under 18 have to go to school, and it does not matter if they want it or not. For example, they may have talents and interests, which they cannot develop at school. In the future, they will make a living from their hobbies, and the knowledge acquired at school is not neccesary in this case.

What is more, for people who really want to learn, this solution also has many advantages. Teachers would have fewer students, so consequently, they could focus on them more and would not lose time for teaching people who do not really want to learn.

On the other hand, everyone should have basic knowledge about geography, history or mathematics, because it is helpful in life. They do not have to be experts in every field of science, but they ought to know where their country is located and who the president is.

Some people claim that knowledge that is not directly relevant to the world of work serves no purpose. I believe there is no evidence to support this view. How can we know exactly which pieces of information any particular student will need in the future? By giving a broad education, including elements of all types of arts and sciences, we help students develop as complete people who can gradually start specializing in the subjects they are most interested in or best at.

To sum up, as far as I am concerned, schools and universities are not simply vocational colleges producing future bankers, mechanics or nurses. They are places where young people should be trained in life-long skills and strategies that help them develop and bring something positive to the society in general.

A child repeats majority of good behaviours and he/she assures in them. Not only do parents create a positive atmosphere, but they also are giving an example for their children. Moreover, children have far stronger motivation to reach their aims as well as an assurance of parents love and proud. An award is sometimes said to be spoiling children, but assigning a penalty is a similar story. Wise parents more often will choose this method which definitely does less harm to their offspring.

To sum up, if somebody asked me, I would choose rewarding children rather than punishing them. I also state that punishment has a lot of sad consequences and is not a reason to motivate children at all.

How to Plan & Write IELTS Opinion Essays

IELTS opinion essays, also known as ‘agree or disagree’ essays, come up frequently in the writing exam. In this lesson, I’m going to show you how to plan and write them step-by-step.

Here’s what we’ll be covering:

• 3 Common mistakes
• Essay structure
• How to plan
• How to write an introduction
• How to write main body paragraphs
• How to write a conclusion

Once you understand the process, practice on past questions. Take your time at first and gradually speed up until you can plan and write an essay of at least 250 words in the 40 minutes allowed in the exam.

The Question

The first part of the question for an IELTS opinion essay will be a statement. You will then be asked to give your own opinion about the statement. Here is some typical wording that might be used:

• What is your opinion?
• Do you agree or disagree?
• To what extent do you agree or disagree?

Give reasons for your answer and include any relevant examples from your own knowledge or experience.

Write at least 250 words.

I’ll be using this question to guide you through the process of planning and writing an IELTS opinion essay.

3 Common Mistakes

These three errors are common in IELTS opinion essays.

• Not stating an opinion.
• Giving arguments for both views.
• Not supporting your opinion with clear reasons.

The most common mistake that students make is not giving an opinion. The question will clearly state that you must choose one side of the argument. If you fail to do this, you will get a low score for task achievement.

It doesn’t matter which side of the argument you take or even, that you agree with it. Choose the one you can develop the best argument for.

Make sure that you don’t change your opinion part way through the essay, and don’t give reasons for the opposing view.

Essay Structure

Now let’s look at a simple structure you can use to write opinion essays. It’s not the only possible structure but it’s the one I recommend because it’s easy to learn and will enable you to quickly plan and write a high-level essay.

1)  Introduction

• Paraphrase the question
• Give your opinion
• State two supporting reasons

2)  Main body paragraph 1

• Topic sentence – outline 1st reason for supporting this view
• Explanation – explain this idea
• Example – give an example  or expand the idea

3)  Main body paragraph 2

• Topic sentence – outline 2nd reason for supporting this view
• Example – give an example or expand the idea

4)  Conclusion

• Summarise opinion and key reasons

This structure will give us a well-balanced essay with 4 paragraphs.

We now need some ideas to add into the structure and we’ll have everything we need for our essay.

How To Plan IELTS Opinion Essays

# 1  decide on your opinion.

The question I've chosen to work on is quite straightforward and easy to understand so we don’t need to spend time analysing it. The first task, then, is to decide on our opinion.

Here’s the question again:

A big salary is much more important than job satisfaction.

Do you agree or disagree?  

For this essay, I’m going to disagree with the statement and argue that job satisfaction is more important than a big salary.

# 2  Generate ideas

The second task is to generate some ideas to write about.

Since I‘m going to argue that job satisfaction is more important than a large salary, I need ideas to support this view.

There are several different ways to think up ideas. I cover them fully on the  IELTS Essay Planning  page.

With this particular question, I immediately thought of a couple of examples of situations where job satisfaction did prove to be more important than a high salary, so I’m going to use the ‘example method’ of generating ideas.

Once you’ve thought of an example or two, ideas to include in your essay should come to you easily.

You might want to try this yourself before reading on for my ideas.

Here are my examples and some ideas they generated.

Both the examples are partly true but I've adapted them to better fit the essay. It's fine to do this as the examiner won't check your facts.

• Uncle Barry – boasted about high salary but hated his job. Nervous breakdown – lost job & can’t work.
• Me – gave up teaching. Now enjoy my work and am much more relaxed and happy even though I earn much less money.
• High-salary jobs are generally more stressful
• Stress leads to ill health, both mental and physical
• 40 hours a week at work – a third of the day
• Money doesn’t bring happiness
• Better quality of life
• Sense of fulfilment
• Less stressed – healthier and happier

I’ve got more ideas here than I need so I’m going to pick two to develop in the essay – one for each of the main body paragraphs.

Idea 1 – High-salary jobs are generally more stressful and can lead to ill health.

Idea 2 – Job satisfaction gives a sense of fulfilment.

We’re almost ready to start writing our IELTS opinion essay but first, we have one other small task to do.

# 3  Vocabulary

In an IELTS essay, it’s important to be able to say the same things in different ways, either by paraphrasing and/or using synonyms. During the planning stage, quickly jot down a few synonyms of key words you could use to save you having to stop and think of the right language while you’re writing.

For example:

satisfaction – fulfilment, achievement, sense of accomplishment, content, sense of well-being

salary – income, wages, pay, earnings

important – significant, valued, has more meaning

job – work, employment, position

With that done, we can focus on the first paragraph of the essay – the introduction.

How To Write an Introduction

A good introduction has a simple 3 part structure:

1)  Paraphrased question

2)  Thesis statement

3)  outline statement.

An introduction should:

• Have 2-3 sentences
• Be 40-60 words long
• Take 5 minutes to write

1)  Paraphrase the question

Start your introduction by paraphrasing the question.

     Question:  A big salary is much more important than job satisfaction.

                       Do you agree or disagree?  

Paraphrased question:  

It is argued that earning lots of money has more significance to people than being content in their work.

Note that I’ve used some of the synonyms I listed, although it’s fine to repeat one or two words if you need to. Above all, your language must sound natural.

In IELTS opinion essays, the thesis statement is where you state your opinion. For example,

    Thesis statement:  

    This essay totally disagrees with that statement.

That’s all you need to say.

If you decided to agree with the statement, you would write:

'This essay completely agrees with that statement.'

Finally in the introduction, you must outline the two main points (ideas 1 and 2 above) that you’ll cover in the rest of the essay. Do it in one sentence, or you can add them onto the end of the thesis statement if appropriate.

Outl ine statement:  

I believe that people are increasingly concerned about the risk of stress-related ill-health frequently experienced by people in highly paid positions and they care more about feeling fulfilled at work.

So, let’s bring the three elements of our introduction together.

     Introduction

This introduction achieves three important functions:

• It shows the examiner that you understand the question.
• It acts as a guide to the examiner as to what your essay is about.
• It also helps to keep you focused and on track as you write.

The two ideas in your introduction will become your two main body paragraphs.

Main body paragraph 1  – concerns about the risk of stress-related ill-health

Main body paragraph 2  – a sense of fulfilment at work

How To Write Main Body Paragraphs

The structure of a good main body paragraph has 3 parts:

• Topic sentence
• Explanation

If you can’t think of an example, you can add further supporting ideas but we already have our two examples so that’s not an issue here.

A common problem when writing main body paragraphs for IELTS opinion essays is having too many ideas. Again, we have already chosen the two ideas we are going to develop, so we are all set to start writing.

You can see how important the planning stage is and how it makes the actual writing of the essay far quicker and easier.

Main Body Paragraph 1

The  topic sentence  summarises the main idea of the paragraph. That’s all it needs to do so it doesn’t have to be complicated.

It plays an important role in ensuring that your ideas flow logically from one to another. It does this by acting as a signpost for what is to come next, that is, what the paragraph will be about.

If you maintain a clear development of ideas throughout your essay, you will get high marks for task achievement and cohesion and coherence.

We’ll now take the idea for our first main body paragraph and create our topic sentence.

Main idea 1  – concerns about the risk of stress-related ill-health

Topic sentence:  

Employees earning a large income are generally under significant mental and emotional pressure to perform well and achieve targets.

Next, we must write an  explanation sentence . This explains to the examiner what we mean. It expands on our first idea.

Explanation sentence: 

This causes many individuals to suffer high levels of stress which can result in both mental and physical health problems.

Finally, we add an  example  to support our main point. I thought of this in the planning stage so I have it ready to use.

If you can’t think of a real example, it’s fine to make one up, as long as it’s believable. The examiner isn’t going to check your facts.

Example sentence:

This happened to my uncle. He used to boast about his huge salary but the boss kept increasing his sales targets and in the end, the stress became too great and he had a nervous breakdown. Now he regrets being driven by the money.

That’s the 3 parts of our first main body paragraph complete. Here’s the finished paragraph.

We now follow the same process for our second main body paragraph.

Main Body Paragraph 2

Main idea 2  – Job satisfaction gives a sense of fulfilment.

First, we write the  topic sentence  to summarise the main idea.

Topic sentence:

Having a job that they enjoy doing, and in which they feel valued, is a major concern for most of the modern workforce.

Now for the  explanation sentence  to explain this idea.

Explanation sentence:

A significant number of people are giving up well-paid positions to do jobs which pay less but that they find more enjoyable and less stressful.

Finally, an  example  to support our main point. As before, I thought of this in the planning stage so just need to form it into a couple of sentences.

I am an example of this myself. A year ago I left the teaching profession because the workload had become too great and I am now a gardener. I feel really fulfilled in this work and I am much more relaxed and happy even though I earn far less money.

That’s the 3 parts of our second main body paragraph complete. Here’s the finished paragraph.

Now we need a conclusion and our IELTS opinion essay is done.

How To Write a Conclusion

Conclusions to IELTS opinion essays should do two things:

• Summarise the main points
• State your opinion

This can generally be done in a single sentence.

If you are below the minimum 250 words after you’ve written your conclusion, you can add an additional prediction or recommendation statement.

The conclusion is the easiest sentence in the essay to write but one of the most important.

A good conclusion will:

• Neatly end the essay
• Link all your ideas together
• Sum up your argument or opinion
• Answer the question

If you achieve this, you’ll improve your score for both task achievement and cohesion and coherence which together make up 50% of the overall marks. Without a conclusion, you’ll score below band 6 for task achievement.

You can start almost any final paragraph of an IELTS opinion essay with the words:

• In conclusion

        or

• To conclude

Now all you need to do is briefly summarise the main ideas into one sentence.

Dnes se podíváme na to, jak nejlépe psát „opinion essey“ v angličtině. Tento druh eseje bývá často u zkoušek na vysoké škole, u testů např. na FCE, případně při přijímacím řízení do zaměstnání. Protože se jedná už o pokročilou angličtinu a protože poznámky mám rovnou v angličtině, nebudu text překládat a nechám to zde v originále. Hodně štěstí u Vašich zkoušek!

Content recommendations

• Do not re-summarize the article in the opinion paper.
• Do not simply use direct translation of text in the article.
• The opinion essay should focus on a subject discussed in the article. It should NOT just discuss the content of the article itself or the quality of the article. (for example, don´t tell us the article on privatization was boring; we want your opinion on privatization itself.)
• focus on an item, show your comprehension of it and develop it further in your essay.
• DO NOT mix advantages/disadvantages (pros/cons) in the same body paragraph. In fact, you are advised to pick a position (e. g. for or against) and focus only on it.
• The use of some transition words is expected and required; use of a variety of them will be rewarded.
• You are expected to state an opinion in the text and then support it; the ability to do so without using the first person, will be rewarded. (Example: „Economics is a vital and interesting subject that more people should explore.“ Instead of: „I think that economics is interesting.“

Divide your paper into three main parts: a short introduction, one (or more) body paragraph(s) and a brief conclusion.

Introduction

• We suggest 3-4 sentences maximum.
• This is where you tell the reader what you are going to tell them.
• It consists of general points that lead to the main idea.
• The main idea, or opinion statement, should be expressed in the last sentence of the introduction.

Opinion statement

• The opinion statement should be a complete sentence (in statement form). It may NOT be in question form.
• The opinion statement should state the main idea of the paper.
• EVERYTHING in the paper should directly related to and support the belief of you express in the opinion statement.

Body Paragraph

• This is where you tell us what you want to say.
• This is where you provide details and examples to support the opinion statement you made at the and of the introduction.
• EVERYTHING in the body should directly relate to and support the main idea of the paper.
• The details should be clear and specific.
• An irrelevant, vague or repetitive sentences should be removed.
• Your paragraph(s) should be coherent. – A paragraph is coherent if the reader can see how all of the sentences related to each other.
• Your paragraphs(s) should have unity. – A paragraph has unity if it clearly identifies one idea and elaborates on that idea only (not many others).
• The author should not mix advantages/disadvantages (pros/cons) in the same paragraph.
• You should present your information in a logical sequence.
• Again, please use linking and ransition words (e.g. firstly, secondly/ furthermore, in addition, etc.) For more information and examples, consult the Functions Sections in the PD chapters.)
• Again, for the bachelor´s exam, we suggest 3-4 sentences maximum.
• This paragraph may begin with „In conclusion“ or „To conclude“ or „To sum up“.
• It often restates the opinion statement in different words .
• This paragraph summarizes what you told us in the essay.

Grammar tips / Things to be aware of

• The first thing to remember is: save time to write the essay as well as re-read it before you finish.
• PROOFREAD your work! Double-check the following things:
• Subject / werb agreement
• Singular / plural agreement
• Pronoun agreement
• Avoid ellipses (…).
• In general, avoid using too many abbreviations – tihis is a formal paper.
• Do NOT use slang abbreviations (such as „u“ instead of „you“).
• Be award of capitalization (especially in names: Czech republic!!!).
• Use simple, but COMPLETE sentences.
• Avoid run-on sentences (i.e. Multiple independent clauses that do not need to be linked together).
• Avoid incomplete sentences (fragments).
• Do NOT use a comma before that.
• Do NOT overuse passive constructions – whenever possible, use active ones.
• Do NOT have any „single sentence“ paragraphs (you need at least three sentences together to qualify as a paragraph).
• Avoid starting your sentences with either of these words: „but“ or „and“.

Pravidla pro psaní anglické opinion essay jsou podobná těm, která bychom měli dodržovat při tvorbě naší české úvahy.

Co je argumentační esej

Tento typ eseje můžete znát i pod názvy přesvědčovací esej nebo opinion esej a jedná se o práci, ve které se věnujete nějakému problému a prezentujete argumenty pro a proti . V práci můžete uvést svůj názor, ale je třeba opravdu argumentovat z obou stran, tak abyste čtenáři dokázali, že se v dané problematice skutečně vyznáte a že dokážete zvažovat jak výhody, tak nevýhody.

Struktura argumentační eseje

Přesvědčovací esej, má stejně jako většina esejí v angličtině, výše zmíněnou tříbodovou strukturu . Osnova může tedy vypadat takto:

• Úvod (Introduction)
• Argumenty pro (Arguments in favour)
• Argumenty proti (Arguments against)
• Závěr (Conclusion)

V úvodu argumentační eseje je třeba představit téma, kterému se budete v práci věnovat . Uveďte dostatek informací tak, aby čtenáři věděli, co od práce očekávat, ale zatím neuvádějte žádné konkrétní argumenty, kterým se budete věnovat ve stati. V úvodu můžete také vyjádřit svůj názor na danou věc. Myslete ale také na to, že na základě úvodu se čtenář rozhoduje, jestli si přečte celou práci nebo ne. Je proto důležité, aby byl úvod zajímavý a čtenáře zaujal.

Jak už jsme zmínili, v přesvědčovací eseji je třeba argumentovat z obou stran. Stať tedy rozdělíme na dvě části . V první části uvádějte argumenty pro a v druhé zase argumenty proti.

V závěru byste měli přehledně shrnout hlavní myšlenky celé eseje. Můžete zde také zopakovat váš názor , který by měl vycházet z argumentů, které jste uváděli.

Slovíčka v argumentační eseji

Argumentační esej by měla mít neutrální až formální tón . Jak jsme zmínili výše, u formálních slohových prací je dobré vyhnout se zkráceným formám a hovorovým výrazům.

Samotnou slovní zásobu si budete muset vyhledat sami na základě tématu a k tomu můžete využít slovní databanku. Jak si slovní databanku vytvořit najdete v článku 7 tipů jak napsat esej . V práci se tedy budeme zamýšlet nad výhodami a nevýhodami nakupování online. Pojďme si první vytvořit osnovu, do které si vepíšeme argumenty, které chceme zmínit.

• 3-4 věty, představit problém, vyjádřit svůj názor
• Argumenty pro: pohodlnost, šetří čas, větší výběr, možnost srovnání
• Argumenty proti: nevíme, co kupujeme, vrácení může být komplikované, balíček nemusí dorazit nebo může dorazit poškozený, dopad na životní prostředí
• 3-4 věty, shrnout hlavní myšlenky, zopakovat svůj názor

Podle osnovy si pak můžete najít základní slovní zásobu: online shopping, shopping in stores, convenience, bigger variety, returns, damaged, envieronmental impact, … Pozn. V eseji jsou zvýrazněné fráze, které můžete využít i ve vašem slohu.

Is online shopping better than shopping in stores?

Is online shopping the new normal? With technology on the rise, online shopping is becoming an important part of people’s everyday life. For many people, buying things online is the best way of shopping because of its convenience. In my view , however, going to a store is the better way of shopping.

The biggest advantage of online shopping is definitely how comfortable it is because you can buy anything from your home. Furthermore , online shopping can save you a lot of time as you do not have to go anywhere. Another benefit of shopping online is a bigger variety. In other words, there are more items to choose from. Because of that you can compare a wide range of products and their prices and choose the best one for you.

Despite the many advantages of online shopping, I think that there are also important drawbacks. The biggest disadvantage is that you never really know what you are buying. For example, if you are buying clothes, you cannot be sure that it will fit you or how the material feels. In addition , returns can be complicated and expensive. Another drawback is that your package might arrive later than expected or damaged. Sometimes your package might not arrive at all. Another point against online shopping is the impact it has on the environment. The items are usually wrapped in several layers of plastic and then in a cardboard box. As a result, you are creating unnecessary waste you would not create shopping in a store.

In conclusion, online shopping offers a lot of benefits but also carries many risks. In contrast, shopping in stores is reliable, environmentally-friendly and you do not have to wait before you get to enjoy your new items. Because of that, I believe that shopping in stores is better than shopping online.

‘They Have Established the Backbone of the Case’: Three Lawyers Dissect the Trump Trial

David French, a Times columnist, hosted a written online conversation with Rebecca Roiphe, a former assistant district attorney in the Manhattan district attorney’s office, and Ken White, a former federal prosecutor, to discuss Donald Trump’s Manhattan trial and Michael Cohen’s testimony.

David French: Let’s start with a big-picture question. I have less trial experience than either of you, but this deep into a trial, I always had a sense of the momentum of the case, of who is winning and who is losing. Who is more pleased with the course of the trial so far — the prosecution or the defense?

Rebecca Roiphe: In my view, the prosecution is happier about how things are going than the defense. They have established the backbone of the case, which is the false records, and they have provided a great deal of circumstantial evidence tying Donald Trump to those records and establishing his intent.

Ken White: When you ask who is more pleased with the course of the trial, remember that Trump is usually pursuing a public relations and political strategy at the expense of good courtroom strategy. In that sense, I suspect Team Trump is happy that he’s getting lots of airtime to push his narrative that he’s a victim of the elites and that the trial doesn’t seem to have had much of an impact on his polling numbers.

If you ask me as a trial lawyer, I agree with Rebecca that the D.A. is doing a solid job proving the elements of its case and telling the story in a way likely to grab the jury. So far, they are hitting all the necessary points.

French: Stormy Daniels’s testimony was far more riveting and disturbing than I anticipated. She described a sexual encounter that was fundamentally exploitive and potentially even predatory. In the aftermath, Trump’s lawyer moved for a mistrial, claiming that the details of that testimony could prejudice the jury. What was your assessment of her testimony? Did the prosecution make a mistake in asking her to describe the details of the encounter?

White: This is all on Trump. He’s the one who decided, for ego reasons, to make repeated claims that the sexual encounter never happened. He could have rendered the details irrelevant by keeping his mouth shut, but he had to call her a liar. That makes it relevant. Yes, her description was skin-crawling. She wasn’t a great witness — she was argumentative and had trouble answering questions directly — but she did what the prosecution needed her to do.

Roiphe: The prosecution was in a difficult position. It needed to establish that this story would have been disturbing, so much so that Trump would find it necessary to suppress it. But the judge had admonished them not to bring out too many details. The media got caught up in the sex scene at the expense of the real point of the testimony, and it’s possible that the jury did as well. But I don’t think it will ultimately undermine the case.

French: Is the judge’s decision to deny the motion for mistrial a reversible error?

Roiphe: I don’t think this will cause a huge legal problem for the prosecution on appeal. Defense lawyers call for mistrials all the time, and judges have a great deal of latitude in dealing with moments like these when testimony slips out that should not have.

French: Let’s talk about Michael Cohen for a moment. His testimony is obviously crucial for the prosecution, but as is often the case, the prosecution is using the testimony of a criminal to try to convict the defendant. How vulnerable are criminal informants to impeachment, and how do juries tend to process their testimony?

White: It’s a rookie mistake for a prosecutor to try to argue, “Actually, our cooperator isn’t that bad.” Cohen is that bad. Redemption tour and podcast or not, he’s a convicted liar. Fortunately the D.A. isn’t making him out to be an angel.

Roiphe: The prosecution has done a great job in setting up Cohen’s testimony. They have used other witnesses to paint him as a misfit, a liar, a bully. You don’t have to like Cohen to believe him. There are so many dots that have already been connected that Cohen is simply going over ground that has already been paved.

White: And prosecutors seem to be using the classic move of using Cohen’s dishonesty against Trump, by showing to the jury that Trump chose Cohen precisely because he’s a crook. Watch for them to lean into that theme in closing: Cohen is a dishonest person who does dishonest things, and that’s why Trump needed him.

Roiphe: There are a few key pieces of his testimony beyond what has already been established that the prosecution hopes the jury will believe. Namely, that Trump led this scheme and was directly involved in the cover-up.

French: I want to share my chief concern about the case. Readers may recall that to secure a conviction for a felony, the prosecution doesn’t just have to prove that Trump falsified business records but that he did so in furtherance of another crime. In your judgment, is the prosecution doing enough to establish that crucial element of the case? And is that element of the case legally robust enough to survive an appeal?

Roiphe: I am not as concerned about the vulnerability of this case as others have been. There has been a lot of testimony about Trump’s concern about these women’s stories and how they would affect the election. This testimony has come from pretty uncontroversial witnesses like Hope Hicks. In a way, it’s just common sense: Why were all these people involved in such a coordinated and intricate effort to make these payments and then lie about them? There are very few plausible reasons other than the one the prosecution has set forth.

White: The jury will be less worried about the nuances of the “furtherance of another crime” element than we commenters are. Juries tend to absorb things on a big-picture story level. The D.A. has done a very solid job connecting Trump’s deceit and hush-money payments to campaign concerns, not to family embarrassment.

French: It would be a dreadful outcome for the country if Trump is convicted before the election, only to have that conviction reversed afterward. It would provide rocket fuel for the argument that the prosecution was little more than partisan election interference.

Roiphe: For the D.A.’s office, in terms of the legal question, this just doesn’t look all that different from other cases that it regularly prosecutes. Sure, the means are different. But I think the New York courts will see this as consistent with the very broad interpretation they have given to this statute.

French: Has the defense scored any obvious points? My perception, much like yours, is that the prosecution has done a solid job of building its case. But are there any surprising weak points? What’s the defense’s best moment so far?

Roiphe: I thought the defense scored some points with Stormy Daniels, even though overall her testimony was solid. Trump’s lawyer Susan Necheles argued that Daniels had a vendetta, that she hates Trump and that she has been inconsistent in telling this story. But the jury doesn’t really have to think her motives are innocent, as long as they believe the basic story. And I don’t think the defense managed to blow up her testimony in any important way.

White: The defense’s attempts to shame Stormy Daniels for being an adult film performer fell flat, as they should. I think the defense’s best opportunity to really shine will come during the cross-examination of Michael Cohen.

French: Justice Juan Merchan has one of the most challenging jobs in trial judge history. He’s presiding over the prosecution of a former president, and Trump is an extraordinarily defiant defendant. How’s he doing?

Roiphe: One of the hardest things for the judge is whether and to what extent to take into account the identity of the defendant in making decisions. For the most part, the judge has treated this like any other trial and in that way has done a solid job and appeared impartial.

White: Justice Merchan has a thankless job. The defense is treating him extremely disrespectfully, and the prosecution is being impatient. When he is cautious and methodical, as he has been in taking the gag order and contempt issues slowly and carefully, half the country is frustrated that he hasn’t thrown Trump in jail, and half is furious that he’s persecuting Trump.

Roiphe: The gag order has really been a test. It would be such a spectacle to throw a former president in jail for contempt. It would have played right into Trump’s victim narrative.

White: Overall, he seems to be doing a thoughtful, patient job.

French: My understanding is that the defense wasn’t necessarily planning on calling a large number of witnesses, and I certainly don’t expect Trump to testify. When their turn comes to make their case, what do you expect? How much will the defense tell its own story, as opposed to resting mainly on cross-examination of prosecution witnesses?

Roiphe: Some of that might depend on how well Cohen holds up on cross-examination. If the prosecution looks as strong as it does now at the time the government rests its case, I think the defense will feel a lot of pressure to put on some sort of case.

It’s hard to know what sort of defense they would put on, given that they never really settled on one theory. They went in with the sweeping argument that Trump did nothing at all wrong. They would have a hard time establishing that his conduct was perfect. But they may be able to buttress some of the smaller arguments they have raised if they can call witnesses who could undermine the prosecution’s argument about his intent.

White: The Trump team will make the decision based largely on political strategy, not courtroom strategy. They may offer some witnesses who will advance the campaign narrative of Trump the victim.

French: In normal circumstances, applying a political strategy to a criminal prosecution would be foolish. You could make yourself popular but still go to jail.

Roiphe: The defense essentially shifted the burden to themselves to prove their client is perfect, when all they had to do was show that the prosecution failed to prove its case. But from a political perspective, that’s so Trump, and it has worked for him.

French: In this circumstance, how much could a political victory help Trump legally? This would be a state conviction, not federal, so his control over the Department of Justice doesn’t matter, and he would not have the power to pardon himself. But would a political victory make a conviction fundamentally irrelevant?

Roiphe: Practically, the appeals process will inevitably take time, and I doubt if Trump wins the election, he would be sent to state prison. So maybe in the long run, it’s not a terrible miscalculation.

White: Since the Mueller investigation, Trump has consistently done things that are foolish legally but promote his narrative — his brand. We saw that recently in the E. Jean Carroll trials, we saw it throughout the investigations leading up to the four criminal cases against him, and we’re seeing it in court now. The smart play here, for instance, would have been to say it doesn’t matter whether or not he had a relationship with Stormy Daniels, because that renders big chunks of the case irrelevant. But character is destiny, and Trump’s character is egotistical and combative.

French: Let’s end with some lightning round questions. First, since the trial has started, in your view has the chance of conviction gone up or down?

Roiphe: Up.

White: Up significantly.

French: Trump is supremely irritated by the judge’s gag order, and while gag orders are infrequent, they’re not all that unusual. Is the gag order in this case justified?

Roiphe: Yes, although I think there should be an exception when witnesses like Michael Cohen have been so public and vocal.

White: We should thank Trump for making law on gag orders. We have a very detailed D.C. Circuit opinion now that will be extremely helpful in a First Amendment area that was previously not well charted. By being so willing to antagonize the judge and by being able to afford lawyers to brief and appeal the gag order, Trump’s helping clarify the law.

French: One last question: J.D. Vance has been mentioned as a potential Trump vice-presidential pick, and he showed up at court on Monday to support Trump. Who is the next V.P. hopeful to make an appearance?

Roiphe: The ghost of Kristi Noem’s dog?

White: It’s going to be Alex Jones or any cop who has pepper-sprayed at least five student protesters.
